De ahí que, el estudio de esta garantía de imparcialidad en el nuevo proceso penal se debilita cuando el juez del juicio oral se “contamina” con los hechos objeto de juzgamiento, ya sea en etapas previas dentro del proceso penal o actuando como órgano jurisdiccional en otro proceso, como es el caso de la presente investigación. De ahí que la investigación, giro en torno al siguiente enunciado del problema: “¿De qué manera se afecta el principio de imparcialidad judicial en los procesos de violencia contra la mujer y demás integrantes del grupo familiar en el juzgado mixto de Ayabaca?”, a la que luego de someter a la investigación y los métodos y técnicas utilizadas se llegó a comprobar la hipótesis principal de que: en los procesos de violencia contra la mujer y demás integrantes de grupo familiar en el Juzgado Mixto de Ayabaca se vulnera el principio de imparcialidad judicial, en razón de que la juez a cargo del Juzgado Mixto cuenta con funciones de Juez Unipersonal, recayendo en la misma persona emitir las medidas de protección y la sentencia, causando la afectación de un principio consagrado constitucionalmente. Posteriormente se desarrolló la discusión de los resultados obtenidos producto del material de investigación que se recabó, llegando a desembocar en las conclusiones respectivas en la investigación.

Hence, the study of this guarantee of impartiality in the new criminal process is weakened when the judge of the oral trial is ““contaminated““ with the facts under trial, either in previous stages within the criminal process or acting as a jurisdictional body in another process, as is the case of the present investigation. Hence, the investigation revolved around the following statement of the problem: ““How is the principle of judicial impartiality affected in the processes of violence against women and other members of the family group in the mixed court of Ayabaca?““ which, after submitting to the investigation and the methods and techniques used, the main hypothesis was verified that: in the processes of violence against women and other members of the family group in the Mixed Court of Ayabaca, the principle of judicial impartiality, due to the fact that the judge in charge of the Mixed Court has the functions of a Single-person Judge, falling on the same person to issue the protection measures and the sentence, causing the affectation of a constitutionally enshrined principle.
