description La investigación se originó con el propósito de determinar si la aplicación de la regla general de la tenencia compartida dispuesta en la Ley N° 31590 resulta beneficiosa o contradictoria al principio del interés superior del niño y adolescente. En esa línea, la investigación es de orientación básica, y de acuerdo a la técnica de contrastación descriptiva. Tiene un diseño de contrastación cualitativo. Asimismo, se ha analizado el principio del interés superior del niño y adolescente, en su marco de protección convencional, constitucional y legal. En la misma línea, se realizó un contraste entre la legislación nacional y comparada y se analizó casuística expedida por los magistrados de la Corte Superior de Justicia de La Libertad, sobre la tenencia compartida, enfocada con el principio del interés superior del niño y adolescente. En consecuencia, se determinó que la aplicación de la regla general de la tenencia compartida dispuesta en el Código de los niños y adolescentes beneficia al principio del interés superior del niño y adolescente, pues aunque la tenencia compartida sea la opción preferente se fija como excepción la tenencia exclusiva en aplicación del ISN. No obstante, se propone su modificación, para que la tenencia compartida pueda encontrarse más acorde al principio del interés superior del niño, asegurando que este principio fundamental guíe todas las decisiones y acuerdos, con el objetivo de proteger el bienestar integral de los niños y adolescentes en situaciones de separación parental.

In this context, the research is of a basic nature and follows a descriptive comparison technique. It employs a qualitative comparison design. Furthermore, the principle of the best interest of the child and adolescent was analyzed within its conventional, constitutional, and legal protection framework. Similarly, a comparison was made between national and comparative legislation, and case law issued by the judges of the Superior Court of Justice of La Libertad regarding joint custody was analyzed, focusing on the principle of the best interest of the child and adolescent. As a result, it was determined that the application of the general rule of joint custody established in the Children and Adolescents Code benefits the principle of the best interest of the child and adolescent, as joint custody is preferred but exclusive custody is established as an exception in the application of the best interest of the child.
