Los métodos empleados en esta investigación fueron: deductivo porque se interpretó la información y datos obtenidos, analítico puesto que se analizaron las posturas doctrinarias con relación a la permanente incapacidad moral, sintético ya que se construyó, organizó y plasmó la información obtenida; dentro de los métodos propios del derecho: dogmático a través del cual se estudiaron las instituciones jurídicas y su regulación normativa, hermenéutico para comprender el fenómeno de la causal de vacancia por la permanente incapacidad moral, su naturaleza jurídica, su conceptualización y regulación, Derecho Comparado mediante el cual se constató el tratamiento de esta institución jurídica en los ordenamientos jurídicos de Colombia, Ecuador, Argentina e Italia. Estos métodos permitieron determinar qué la causal de vacancia presidencial por incapacidad moral permanente no resulta acorde a la seguridad jurídica, por cuanto restringe la libertad de mandato.

The methods used in this research were: deductive because the information and data obtained were interpreted, analytical since the doctrinal positions in relation to permanent moral incapacity were analyzed, synthetic since the information obtained was constructed, organized and captured; within the methods of law: dogmatic through which legal institutions and their normative regulation were studied, hermeneutic to understand the phenomenon of the cause of vacancy due to permanent moral incapacity, its legal nature, its conceptualization and regulation, Comparative Law through which confirmed the treatment of this legal institution in the legal systems of Colombia, Ecuador, Argentina and Italy.
