Bajo ese contexto, el problema de la presente investigación se enunció de la siguiente manera: ¿EN QUÉ MEDIDA LA REFORMA CONSTITUCIONAL DEL ARTÍCULO 113, INCISO 2, QUE INCORPORE LOS REQUISITOS DE FORMA INFLUIRÁ EN LA APLICACIÓN DE LA VACANCIA PRESIDENCIAL POR PERMANENTE INCAPACIDAD MORAL EN EL PERÚ, 2023? ; ante lo cual formulamos los siguientes objetivos: 1) Desarrollar los alcances del proceso de vacancia por incapacidad moral permanente. 2) Postular los requisitos de forma a la vacancia por incapacidad moral permanente que se requiere incorporar al texto constitucional. 3) Identificar y analizar casos donde se haya aplicado la vacancia por incapacidad moral permanente. 4) Analiza la figura de vacancia presidencial por permanente incapacidad moral en el derecho comparado. Por otro lado, nuestra hipótesis se describe de la siguiente manera: La reforma constitucional del artículo 113, inciso 2, que incorpore requisitos de forma influirá positivamente en la aplicación de la vacancia presidencial por permanente incapacidad moral en el Perú.

In this context, the problem of the present investigation was stated as follows: TO WHAT EXTENT WILL THE CONSTITUTIONAL REFORM OF ARTICLE 113, SECTION 2, THAT INCORPORATES THE REQUIREMENTS IN A FORM, WILL INFLUENCE THE APPLICATION OF THE PRESIDENTIAL VACANCY FOR PERMANENT MORAL DISABILITY IN PERU, 2021? ; To which we formulate the following objectives: 1) Develop the scope of the vacancy process due to permanent moral disability. 2) Postulate the formal requirements for the vacancy due to permanent moral disability that is required to be incorporated into the constitutional text. 3) Identify and analyze cases where the vacancy due to permanent moral disability has been applied. 4) Analyze the figure of presidential vacancy due to permanent moral incapacity in comparative law.
