Daño al proyecto de vida y su reconocimiento en el derecho peruano como aporte al derecho continental

La presente investigación busca demostrar el aporte del Derecho peruano al sistema jurídico latino y que en el presente trabajo denominamos “Derecho continental” El aporte identificado es el relacionado al reconocimiento del daño al proyecto de vida como una categoría contenida en el daño a la persona que ha sido reconocido de forma expresa, como una categoría del daño resarcible, por el artículo 1985 del Código civil peruano de 1984, radicando allí el aporte a destacar por parte del Derecho peruano. Se demostrará que dentro de la noción del Daño a la persona se entiende el daño al proyecto de vida, toda vez que esta es la noción que pacíficamente se ha adoptado no solo en nuestro medio por obra y esfuerzo intelectual del maestro y profesor Carlos Fernández Sessarego sino por la doctrina especializada, como la italiana y argentina Se ha demostrado que, con el aporte de la jurisprudencia supranacional y posteriormente de la interna, el Perú y otros países latinoamericanos, han ido decantando por el reconocimiento del daño al proyecto de vida como daño resarcible contenido en la noción del daño a la persona el artículo 1985 del Código civil, llegándose incluyo, en el caso del Código civil argentino del 2015 a reconocerlo de forma expresa Para la presente investigación se ha utilizado como técnica de recolección de datos: La encuesta y la revisión bibliográfica y jurisprudencial; siendo que entre los encuestados se ha consultado a destacados profesores de responsabilidad civil del País, y en relación a la recolección de información se ha consultado los libros nacionales publicados sobre la materia, así como basta doctrina extranjera En la presente investigación, se ha analizado fundamentalmente en el campo legislativo el artículo 1985 del Código civil y sus normas vinculadas, además de la Constitución del Estado y otras normas ordinarias, se ha consultado casi la totalidad de la doctrina nacional que ha abordado el tema, así como la principal doctrina extrajera como la italiana, francesa y argentina. Se ha llegado, entonces a demostrar que en el Derecho peruano es pionero en reconocer el daño a la persona como daño resarcible y dentro de aquel se reconoce al daño al proyecto de vida, siendo este el aporte fundamental del Derecho peruano al Derecho continental. ----- This research seeks to demonstrate the contribution of Peruvian Law to the Latin legal system and what in this work we call “Continental Law.” The identified contribution is related to the recognition of damage to the life project as a category contained in the damage to the person that has been expressly recognized, as a category of compensable damage, by article 1985 of the Peruvian Civil Code of 1984, Therein lies the contribution to be highlighted by Peruvian Law. In the present investigation, article 1985 of the Civil Code and its related regulations have been fundamentally analyzed in the legislative field, in addition to the State Constitution and other ordinary regulations, almost all of the national doctrine that has addressed the topic has been consulted. , as well as the main foreign doctrine such as that of Italy, France and Argentina. It has been demonstrated, then, that Peruvian Law is a pioneer in recognizing damage to the person as compensable damage and within that, damage to the life project is recognized, this being the fundamental contribution of Peruvian Law to continental Law.
