Sumario:This research addresses the issue of liability for labor claims within business groups in Iquitos during the period 2019-2023, within the context of productive decentralization and the absence of clear regulatory norms in Peruvian labor legislation. The study is justified by the need to protect workers’ rights, which are affected by business practices that, through the use of business group structures, dilute or evade labor obligations. The main objective was to identify the legal and jurisprudential criteria used to determine who assumes responsibility for labor claims within these groups. A qualitative methodology was employed, using a case study design, through the analysis of national and international doctrine, as well as relevant rulings issued by the Supreme Court and the Constitutional Court between 2019 and 2023. Among the most significant findings, the study identified recurrent criteria such as the plurality of employers, asset commingling, unified management, and the transfer of personnel between companies to establish joint liability within business groups. The research concludes that urgent regulatory reform is necessary to address the distortions generated by this corporate structure and to ensure the effective protection of workers' labor claims.
