El objetivo general del trabajo de investigación fue determinar si el delito de prevaricato en el ejercicio jurisdiccional de los jueces, incide en la sanción penal establecida en la Legislación Peruana. El tipo de investigación fue explicativo y el nivel aplicativo; por otro lado, el método y diseño de investigación fue expos facto o retrospectivo; y con relación a la población objeto de estudio estuvo constituida por el Colegio de Abogados de Lima (CAL) y la muestra fue de 378 Abogados hábiles con un muestreo de probabilidad del 95% de confianza y con un margen de error de 5%. Respecto a los instrumentos utilizados para la medición de las variables fue la técnica de la encuesta con su instrumento el cuestionario, el cual fue validado por Jueces expertos que realizaron la evaluación con el Grado de Doctores, quienes dieron la validación de criterios y de constructo; en cuanto a la prueba estadística fue el ji o chi cuadrado, corregida por Yates. En conclusión, se ha determinado que el delito de prevaricato en el ejercicio jurisdiccional de los jueces, incide directamente en la sanción penal establecida en la Legislación Peruana.

The general objective of the research work was to determine if the crime of malfeasance in the jurisdictional exercise of the judges, affects the criminal sanction established in the Peruvian Legislation. The type of investigation was explanatory and the application level; On the other hand, the method and design of the research was expository or retrospective; and in relation to the population under study was constituted by the Lima Bar Association (CAL) and the sample was 378 skilled lawyers with a probability sample of 95% confidence and a margin of error of 5%. Regarding the instruments used to measure the variables, it was the survey technique with its instrument, the questionnaire, which was validated by expert Judges who made the evaluation with the Degree of Doctors, who gave the validation of criteria and construct; as for the statistical test it was the chi or chi square, corrected by Yates.
