description El presente estudio analiza la posibilidad jurídica de plantear la prescripción extintiva en vía de acción dentro del derecho civil peruano. Actualmente, el Código Procesal Civil solo permite que la prescripción extintiva sea invocada como excepción procesal, lo que obliga al deudor a esperar a ser demandado para poder hacer valer la extinción de la obligación. Esta restricción genera incertidumbre jurídica y una carga innecesaria para el sistema judicial. A través del análisis normativo, jurisprudencial y del derecho comparado en países como España, Argentina, Francia y México, se evalúa la viabilidad de modificar la legislación peruana para permitir que los deudores puedan solicitar judicialmente la declaración de prescripción sin necesidad de ser demandados. La investigación concluye que esta reforma fortalecería la seguridad jurídica, reduciría la litigiosidad y optimizaría la administración de justicia.
