description La presente investigación se intitula: “Intervención del testigo en el otorgamiento del testamento por escritura pública”, teniendo como objetivo general fundamentar con argumentos fácticos y jurídicos la innecesaria e inútil presencia de los testigos durante la facción del testamento. Siendo esto así, desde la perspectiva de la ley civil nacional vigente, el testamento por escritura pública asienta sus bases en la manifestación de voluntad del testador ante una autoridad investida por el imperio de la potestad estatal a cuyo favor se ha delegado la función pública de dar fe de actos que ante él se celebra: el notario. De la aplicación de los instrumentos se obtuvieron resultados que mostraron que la mayoría de la población encuestada si considera suprimir la presencia de testigos. En efecto, el notario cumple la labor de dar fe pública de un acto, que ante él se celebra, no corresponde establecer ninguna excepción al respecto, dado que su autoridad es para todo ámbito, través de esta tesis es dar evidencia sustentada de la importancia y utilidad de personas ajenas al testador y al notario en el otorgamiento del testamento, proponiéndose la enmienda legal respectiva en el Código Civil.
