Bajo dicha perspectiva el presente trabajo tiene como base una investigación cualitativa, con una metodología aplicada y un diseño de teoría fundamentada. Finalmente se concluyó que las ordenanzas emitidas en materia tributaria por parte de la Municipalidad Distrital de Nuevo Chimbote, si cumplen con la legalidad que exige la ley, pero; no necesitan ser ratificadas de acuerdo al art.40 de la Ley Orgánica de Municipalidades, ya que no “crean, modifican, exoneran o suprimen tasas, arbitrios, licencias, derechos y contribuciones”. Concluimos también que debería implementarse un proceso interno de ratificación con el fin de salvaguardar el principio de predictibilidad y seguridad jurídica, garantizando así el desarrollo de autonomía de su Potestad Tributaria de la Municipalidad Distrital de Nuevo Chimbote.
