description La investigación estuvo enfocada con el objetivo de desarrollo sostenible de paz, justicia e instituciones sólidas, tuvo como objetivo central analizar el efecto de la indignidad declarada judicialmente en la exclusión del heredero forzoso en los procesos en el Perú 2024. Asimismo, la investigación presenta un enfoque cualitativo, tipo básico, diseño de teoría fundamentada y nivel descriptivo. El escenario de estudios constó de 9 participantes expertos en temas sucesorios, magistrados y abogados, en cuanto a los participantes, se tuvo cuatro magistrados, un especialista legal y cuatro abogados debido a que son los partícipes estelares del procedimiento. Se empleó como herramienta de recolección de datos la guía de entrevista y la guía de análisis documental. Se concluyó que la indignidad declarada judicialmente constituye una sanción civil que excluye al heredero forzoso de la sucesión, conforme al artículo 667 del Código Civil Peruano. Si bien esta exclusión se justifica en la protección de la moralidad y los principios de justicia dentro del derecho sucesorio, su aplicación puede afectar el derecho fundamental a la herencia reconocido en la Constitución Política del Perú (artículo 2, inciso 16).
