description La presente investigación tiene por objetivo analizar cuál es el rol del Tribunal Constitucional con relación a la figura de la vacancia presidencial por incapacidad moral permanente. La metodología que se llegó a utilizar en esta investigación es de diseño de teoría fundamentada, tipo básica y cuenta con el enfoque cualitativo y artículos científicos indexados. Igualmente, se llegó a utilizar como instrumentos de recolección de datos la guía de entrevista y la guía de análisis documental. Se obtuvo como resultado que el Tribunal Constitucional no se llegó a pronunciar sobre la figura de la vacancia presidencial y este vacío legal repercute de manera nociva en el ámbito jurídico, político y social, asimismo no se estableció un significado relevante en relación al termino de incapacidad moral lo cual desemboca en interpretaciones diversas.
