This paper explains these controversies in order to propose a legal solution that avoids impunity and ensures the legitimacy of the legal system.Desde la sentencia del caso Barrios Altos vs. Perú, la Corte Interamericana de Derechos Humanos comenzó a desarrollar el concepto de «graves violaciones de derechos» y sus consecuencias en el ámbito penal nacional. A pesar de ser un estándar consolidado, a la fecha aún existen dudas sobre qué actos deben ser calificados bajo tal categoría jurídica y si resulta válido limitar ciertas garantías procesales y penales con la finalidad de lograr su criminalización.
