Sumario:Actions or omissions of public administration that violate human rights can be controlled internally through mechanisms designed by each State, but also externally by resorting to international protection bodies. Of the possible violations, those of a structural nature are of interest here, that is, those that show a failure of the institutions, actually or potentially affect a large number of people and rights, and require structural solutions by the competent control authority, such as issuing complex orders addressed to the authorities concerned in order to resolve the injury, while agreements are promoted among all those involved and follow-up is carried out until the total or almost total cessation of the injury. It is here that an Unconventional State of Affairs could be declared as an exceptional technique that seeks to provide structural solutions to the violations of rights contemplated in international instruments, sharing similarities with the Unconstitutional State of Affairs (Estado de Cosas Inconstitucional, ECI) developed by some countries such as Perú and Colombia for the protection ofrights recognized at the constitutional level, an expansive formula of the existing control mechanisms whose scope goes beyond the protection of the subjective dimension and encompasses the objective dimension of the rights violated by the public administration.
