These measures, as their name suggests, are requested even before the claim is filed, when there is no arbitral tribunal, since it has not yet been formally constituted. The figure of the emergency arbitrator arises to deal with this need, avoiding that the decision on this type of measures is left in the hands of the jurisdictional bodies, mainly because of the difficulties that could arise from the determination of jurisdiction in international arbitrations.El presente artículo busca poner en valor la labor que las instituciones arbitrales están acometiendo para garantizar una tutela arbitral integral, especialmente en lo que concierne a la adopción de medidas cautelares, incluyendo las llamadas medidas cautelares ante causam. Medidas que, como su nombre bien indica, son solicitadas incluso antes que la demanda, lo que en la práctica se traduce en la ausencia de órgano arbitral; puesto que no ha sido, todavía, constituido formalmente.
