The purpose of this exercise is to identify some of the strengths of this process, in broad strokes, mostly with regard to the protection of fundamental rights and their enforcement in relationships between private individuals. It also seeks to identify and reflect on —through two cases, one involving the protection of the right to collective bargaining, and the other involving the right to freedom of thought— the limits of constitutionalization, as a process and a result, in political relationships and decision-making.Este trabajo presenta algunos de los principales avances y obstáculos del proceso de constitucionalización del ordenamiento jurídico peruano, vinculados al derecho privado, al derecho laboral y a la protección del consumidor, y que han sido abordados principalmente por el Tribunal Constitucional (TC). El ejercicio tiene por finalidad identificar, en líneas generales, algunas de las fortalezas de este proceso, ligadas en la mayoría de los casos a la protección de derechos fundamentales y su efectividad en las relaciones entre particulares. De igual modo, se busca reconocer y analizar, a partir de dos casos —uno vinculado a la protección del derecho a la negociación colectiva, el otro sobre el derecho a la libertad de consciencia—, los límites de la constitucionalización como proceso y resultado en las relaciones y decisiones políticas.application/pdfspaPontificia Universidad Católica del Perú.
