| Sumario: | The author, based on national legislation and the International Law of Human Rights, exposes a critic to the recent judgment STC 1522-2016- PHC/TC of the Constitutional Court of Peru. Considering that it violates the right to effective judicial protection due to it´s established that “in response to new circumstances” of a case, a judgment with the quality of res judicata could be annulled even when in the same case previously had been protected the fundamental right of the defendant. |
