The author makes an analysis of the cause of vacancy by criminal conviction for fraudulent offense with custodial sentence of the municipal authorities and maintains that it is a mechanism of citizen control through which the politicallegal relationship is terminated, caused by causes specifically provided for in the law, issued within an administrative procedure and in accordance with law. It also emphasizes that there is a moral connotation that underlies the rule that sanctions the vacancy of the authority, since in a Constitutional State of law “there are no absolute powers.”
