For this purpose, two remarkable and recent judgments enacted by the Mining Council of the Ministry of Energy and Mines of Peru will be reviewed in order to confirm the need to redefine the role of the Government on encouraging the private investment in this extractive activity.Este artículo tiene como objetivo revisar algunos de los principales fundamentos constitucionales y legales que norman la actividad minera en el Perú, como punto de partida para analizar cómo el debate entre el desarrollo económico y la protección del medioambiente no ha sido correctamente leído y cómo es que ha devenido en una de las principales causas que actualmente alimentan el conflicto social en este sector.
