For this purpose, it intends to specify if this measure is compatible with the paradigm change of our procedural system, and establish what is the reason for its existence. It also emphasizes the importance of language to build the meaning of legal institutions, thereby seeking to determine the legal nature of the Prison, deconstruct their material budgets, and question their current term. Finally, it concludes by providing recommendations to rationalize the use of the Preventive Prison, and noting that while currently seeking to propose criteria to harmonize with constitutional standards, it is impossible, because a Constitutional State can not admit that this institution inherited from the system Inquisitive remains in force, because it violates the state of innocence and the right not to be deprived of freedom without prior trial.El presente trabajo de investigación tiene como objetivo examinar la institución procesal de la Prisión Preventiva. Para ello, pretende precisar si esta medida resulta compatible con el cambio de paradigma de nuestro sistema procesal, y establecer cuál es la razón de su existencia. Asimismo, recalca la importancia del lenguaje para construir el sentido de las instituciones jurídicas, con ello, busca determinar la naturaleza jurídica de la Prisión Preventiva, deconstruir sus presupuestos materiales, y cuestionar su plazo de duración actual.
