Subsequently, it reviews the provisions of the Political Constitution of Peru applicable to prison work, as well as the Penal Enforcement Code and the new Legislative Decree No. 1343, which creates the Productive Prisons Programme, the main rules that regulate such work, in order to determine whether they are in line with the aforementioned standards of human rights protection and examine the problems generated by the lack of recognition of the labour link of work carried out inside prisons.El autor analiza los principales instrumentos internacionales relacionados con el derecho al trabajo, los fines de la pena y el régimen penitenciario y la manera en que delimitan el trabajo realizado dentro de las cárceles por reclusos, así como identifica los estándares internacionales vigentes para su abordaje. Posteriormente, revisa las disposiciones de la Constitución Política del Perú aplicables al trabajo penitenciario, así como el Código de Ejecución Penal y el novedoso Decreto Legislativo n.o 1343, que crea el Programa Cárceles Productivas, principales normas que regulan dicho trabajo, con la finalidad de determinar si se adecuan a los referidos estándares de protección de derechos humanos y examinar los problemas que genera el desconocimiento del vínculo laboral del trabajo realizado dentro de las cárceles.
