La doctrina tradicional, con un fuerte componente francés, ha potenciado que la ley es por excelencia el fundamento jurídico de adecuación social. Bajo este supuesto se ha construido un mito ideológico y jurídico, que ha permeado al mundo occidental, y que ha dibujado Estados bajo el concepto constitucional de la división de poderes. En este contexto han aparecido los jueces constitucionales que desempeñan la noble y trascendental función de ser fieles guardianes de las constituciones democráticas de nuestro tiempo. Estas no son palabras de circunstancia, al contrario, nos pone frente a un pensamiento general sobre el que vale la pena reflexionar.
