Therefore, the State cannot be limited to ensure the environmental conditions of an alleged inherent social order, not to monitor the unrest in a self-regulating mechanism, but, on the contrary, must be the key regulator of the social system and must be available to the task of structuring society through direct or indirect measures. That is, the state cannot remain a simple traffic policeman, but become real and effective regulator or social policy, economic structure and the political and legal system of the country. The modern state, according to its political formula must ensure that the economic structure and the legal and political system to suit the requirements of the majority, so as to protect the state system. It is the social interests constitute a real expression of the will of the nation and democracy work not only in the social and political, but also economic.El Estado moderno, al que identificamos básicamente como el Estado social y democrático de derecho, parte de la experiencia de que la sociedad, dejada total o parcialmente a sus mecanismos autorreguladores, está librada a la pura irracionalidad, y que sólo la acción del Estado hecha posible por el desarrollo de las técnicas administrativas, económicas, de programación, de decisiones, etc., puede neutralizar los efectos disfuncionales de un desarrollo económico y social no controlado. Por consiguiente, el Estado no puede limitarse a asegurar las condiciones ambientales de un supuesto orden social inmanente, tampoco a vigilar los disturbios de un mecanismo autorregulado, sino que, por el contrario, ha de ser el regulador decisivo del sistema social y ha de disponerse a la tarea de estructurar la sociedad a través de medidas directas o indirectas. Es decir, el Estado no puede quedarse como un simple gendarme de tráfico, sino, convertirse en el real y efectivo o regulador del orden social, de la estructura económica y del sistema político-jurídico del país. El Estado moderno, conforme a su fórmula política, debe garantizar que la estructura económica y el sistema jurídico-político se adecuen a los requerimientos de las grandes mayorías, de manera tal que quede protegido el sistema estadual.
