Precisely on this last point, legal pluralism, from the epistemology of law, responds to an intrinsic and living need of these peoples to perpetuate their knowledge and ancestry in the construction of their own legal systems, validated within their communities, which reflect customs and practices inherited from generation to generation. The scope of this assertion allows us to see a legitimate way to substantiate that legal pluralism should be a de facto reality in Latin American constitutions, where the indigenous population component is significant but still relatively marginalized in national discussion spaces. The case of Arica and Parinacota in the far north of Chile is cited as an example.Se busca analizar el pluralismo jurídico desde su naturaleza sustantiva y originaria, mostrando su validez como sistema normativo que viene a conciliar las necesidades hegemónicas de las construcciones estatales vs las construcciones de grupos colectivos intermedios o mayores; principalmente respecto a los pueblos originarios. Precisamente en este último punto, el pluralismo jurídico desde la epistemología del derecho responde a una necesidad intrínseca y viva de dichos pueblos por perpetuar su conocimiento y ancestralidad en la construcción de sistemas jurídicos propios y validadas en el interior de sus comunidades que hablan de costumbres y usanzas que han sido heredadas generacionalmente. Los alcances de dicha afirmación permiten ver una vía legítima para fundamentar que el pluralismo jurídico debe ser una realidad de hecho en las constituciones latinoamericanas, donde el componente de población de pueblos originarios es relevante, pero aún se encuentra en una relativa marginalidad de los espacios de discusión nacionales.
