In this sense, the aim of this research was to analyse the criteria that have been developed in the legislation and in the reflection of the justice administration bodies of Latin American and European countries. It was identified that there are innovative criteria that allow assigning animals the quality of sentient beings and in some cases as subjects of law, which allows expanding the scope of protection in favor of them.La protección de los animales es una de las preocupaciones cada vez más intensas en diversas partes del mundo que se refleja en la producción legislativa y jurisprudencial de los países. En ese sentido, la presente investigación tuvo como objetivo analizar los criterios que se han desarrollado en la legislación y en la reflexión de los órganos de administración de justicia de países de América Latina y Europa.
