It is analyzed, how is it that by continuing in force the procedural rules that allow the acquitted to be convicted, in the face of the contrary position of the jurisprudence, it generates a problem of procedural nature that has to do with the reasonable term in any trial, therefore it is urgent that the Congress of the Republic settle the issue.El presente trabajo tiene como objetivo analizar el inciso 2) del artículo 419 del Código Procesal Penal, concordante con el literal b) del inciso 3) del artículo 425 del Código Procesal Penal, que permite la condena del absuelto por parte de la Sala Penal Superior, norma que permanece vigente a pesar de que la mayoritaria jurisprudencia emitida por la Corte Suprema de la República y el Propio Tribunal Constitucional se han pronunciado declarando que condenar al absuelto viola el derecho a la pluralidad de instancias, derecho fundamental contenido en el inciso 6) del artículo 139 de la Constitución Política del Estado Peruano. Asimismo, el Tribunal Constitucional, en la Sentencia recaída en el expediente N°04374-2015-PHC/TC, de fecha 21 de julio del 2020, exhortó al Congreso de la República para que establezca una modificación al artículo 425, inciso 3, literal b) del vigente Código Procesal Penal que posibilite la revisión, por medio de un recurso ordinario, de la condena del absuelto en primera instancia.
