Rawls seeks to answer these questions and to formulate a theory of justice in search of a just society based on freedom and obligations to others and to oneself.El tema de la justicia es uno de los principios que toca la fibra profunda de todo ser humano que solicita un trato justo en las relaciones con los otros sin importar su credo, color, condición social, etc. Esta misma necesidad particular se ha de expresar en un estado de derecho que legisle no solo conforme a la ley sino también esta ley sea justa en su concepción en bien de la comunidad. Pero ¿qué pasa cuando ello no es así en la realidad? ¿En qué parte del contrato social sufre el quiebre de este principio y otros?
