When inquiring about the main aspects of the adoption system we found that, despite the evolution of regulations and case law, the process is lengthy and difficult, thus many minors are institutionalized for a long time, thus many minors are institutionalized for a long time and potential adoptive families desist from adoption. Adoption is a choice based on love, on a deep conviction of welcoming a new member into the family; it is a measure to restore right and hence need to be addressed and prioritized by legal systems in general. El sistema de adopciones en Colombia enfrenta grandes desafíos frente al alto porcentaje de niños, que no logran ser reubicados en una familia. El objetivo de este estudio fue analizar las fallas que presenta el sistema de adopciones colombiano. La metodología empleada se desarrolló desde la investigación teórica / jurídica y la empírica. Al indagar sobre los aspectos importantes del sistema de adopciones se encontró que, a pesar de la evolución normativa y jurisprudencial, los procesos son extensos y difíciles, lo que genera que muchos niños, niñas y adolescentes (NNA) estén institucionalizados por mucho tiempo y, además, que las posibles familias adoptantes desistan de la adopción.
