But let´s stop for a while: the problem is not constituted by norms or principles; how the judges operate on them has become a kind of Russian roulette that directly affects the procedural subjects under their jurisdiction. This lack of proportionality and reasonableness in the criterio they take directly collides with two variables: the predictability of court decisions and legal certainty. Consequently, those affected are the human rights of the inmates. Even more so if we take into account that in our country prison rehabilitation centers resemble Nazi concentration camps.No descubrimos nada nuevo cuando apuntamos que los operadores jurisdiccionales al decidir sobre la libertad o encarcelamiento de los procesados están afectando derechos humanos trasversales. Pero detengámonos un rato: el problema no lo constituyen ni las normas ni los principios; el como operan los jueces sobre los mismos se ha convertido en una especie de ruleta rusa que afecta directamente a los sujetos procesales sometidos a su jurisdicción. Esa falta de proporcionalidad y razonabilidad en los criterios que toman colisiona directamente contra dos variables: la predictibilidad de las resoluciones judiciales y la seguridad jurídica. Los afectados en consecuencia, son los derechos humanos de los internos.
