Sumario:This study focuses on the analysis of Law No. 30490 and its general principles where the theme runs through the study of tutelary institutions of positive law in the protection and protection of the elderly, whose existence seeks to resolve and prevent exposure, abuse , abandonment towards this vulnerable population. The legal vision establishes a review of the protective nature of the norm and in the articles and complementary final and transitional provisions in the face of a reliable respect for the human being in dignity, this being a purpose of the State and with a guarantee of exercises of rights for improvements. of life and integration within a society that seeks equity in its citizens. The main purpose of this article was to carry out a critical legal analysis in which the simple dogmatic method was used as research. It is concluded that there is no adequate implementation of compliance with existing standards by the guardianship bodies and whose deficiency contributes to a lack of protection of society as a whole towards the elderly.
