However, in recent years, the Member States of the European Union have expressed strong criticisms of the ECT, finding it incompatible with the obligations assumed by the European Union in environmental treaties. This articleseeks to analyze the current landscape of ECT disputes, the criticisms that led to a process of modernizing the original ECT text, and the probable outcomes of this modernization process considering the European Union's critical stance regarding the investor-state dispute resolution system. We cannot help but wonder: are we witnessing the chronicle of a withdrawal announced by the European Union Member States?El origen de la TCE se remonta a finales de la Guerra Fría, en donde el contexto histórico ofrecía una oportunidad de cooperación en el sector energético entre los países de Europa del Este y del Oeste. Sin embargo, en los últimos años los Estados Miembros de la Unión Europea han manifestado duras críticas al TCE por resultar incompatible con las obligaciones asumidas por la Unión Europea en tratados ambientales. El presente articulo busca analizar el panorama actual de disputas del TCE, las críticas que llevaron a un proceso de modernización del texto original del TCE, y los probables resultados de dicho proceso de modernización en atención a la postura crítica de la Unión Europea en relación con el sistema de resolución de disputas entre inversores y Estados. No dejamos de cuestionarnos, ¿nos encontramos ante una crónica de una retirada anunciada por parte de los Estados miembros de la Unión Europea?Universidad de Lima.
