For this research, it has considered Kelsen and Bianchi as representative of both epistemological approaches, respectively. In this sense, the article examines the Bianchi´s approach on interpretation, which considers interpretation as a ludic activity to own an objective, a specific context, rules, players and strategies. El presente trabajo tiene como finalidad explorar la consideración científica del derecho internacional desde el positivismo, para sostener que la posición postmoderna que pone énfasis en la labor interpretativa es la que resulta más adecuada para explicar el fenómeno jurisdiccional del derecho de gentes actual, sobre todo por la presencia de múltiples tribunales internacionales permanentes. Para esta investigación, se ha considerado a Kelsen y a Bianchi como representantes, respectivamente, de ambos abordajes epistemológicos.
