This article proposes its regulation based on a normative support protected by the Peruvian legal system and the obligation of the Right to adapt to new conceptions of family.La maternidad subrogada gestacional altruista es una Técnica de Reproducción Asistida (TRA) que permite a muchas parejas convertirse en padres y que cada vez cobra mayor relevancia en nuestro país. Sin embargo, este método de procreación no está regulado de forma clara en nuestra legislación, lo cual ocasiona graves perjuicios jurídicos y sociales.
