Likewise, the Peruvian health system was forced to face various challenges, through tools such as the application of public policies and implementation of special regulations, which mostly had an impact on the determination of the responsibility of health professionals during the state of health emergency. In this sense, in this research work, civil medical-sanitary liability will be addressed, based on a study of the application of the lex artis according to the national legal system. To do this, it will start with a study of medical-health civil liability in Peru, detailing what types of obligations apply depending on the case and identifying the actors in the health system who can be accused. Secondly, the lex artis is presented as a parameter of diligence, for which a study of concepts is provided, and it is differentiated from linked notions such as the lex artis ad hoc. Finally, the main challenges that Peru faced during the covid-19 pandemic and their impact on the determination of civil medical-health responsibility were established.Uno de los temas de discusión claves durante y después de la pandemia ocasionada por la aparición del covid-19 alrededor del mundo, es la responsabilidad civil generada a propósito de la actuación de los profesionales de la salud (tomando en cuenta la estructura sanitaria) ante las situaciones de emergencia imprevisibles en dicho contexto. De igual modo, el sistema de salud peruano se vio en la obligación de hacer frente a diversos desafíos, a través de herramientas como la aplicación de políticas públicas e implementación de normativa especial, que, en gran medida, tuvieron un impacto en la determinación de la responsabilidad de los profesionales de la salud durante el estado de emergencia sanitaria. En ese sentido, en el presente trabajo de investigación se abordará la responsabilidad civil médico-sanitaria, a partir de un estudio de la aplicación de la lex artis según el sistema jurídico nacional. Para ello, se partirá con un estudio de la responsabilidad civil médico-sanitaria en el Perú, detallando que tipos de obligaciones se aplican según el caso particular e identificando a los actores en el sistema sanitario que pueden ser imputados. En segundo término, se presenta a la lex artis como un parámetro de diligencia, para lo cual se brinda un estudio de conceptos y se le diferencia de nociones ligadas como la lex artis ad hoc.
