Thus, the author raises relevant issues such as the treatment of rescission or termination in this type of contract, the theory of risk and its shortcomings in the Peruvian civil code.El presente trabajo proporciona una visión general del contrato sinalagmático o contrato bilateral en el derecho comparado, con especial enfoque en la legislación alemana e italiana y, su comparación con el sistema legal peruano. En ese contexto, el artículo aborda la conceptualización, aplicación y regulación del contrato bilateral definiéndolo como aquel que alberga una pluralidad o reciprocidad de obligaciones que deben ser cumplidas por cada una de las dos partes.
