Finally, a perspective that allows to identify the most efficient solution.El presente artículo plantea la problemática generada por la retención de la carta fianza de fiel cumplimiento hasta el consentimiento de la liquidación practicada en los contratos de ejecución de obra, bajo el régimen general de contratación pública; los impactos que ello genera en la dinámica del sector construcción, específicamente, en los casos en los que la obra fue recibida a conformidad de la entidad. Además, se analiza el último cambio normativo – vigente desde el 2019 – el cual esboza una paliativa solución que propone la devolución e intercambio de fianza de fiel cumplimiento por un menor monto asegurado.
