description This paper is about the relationship between the Law and violence from an environmental perspective. The author indicates that from a historic perspective there is complex relationship between the man and the nature. Then, the conception of the reality influence in how the legal system regulated some aspect related with the environment. From the dialectical interpretation, it is proposed the conflict between the human activity and nature. It is said that the nature reacts due to the affectation that suffers by the human being. Moreover, just the climate change does not affect the environment only, but many activities that are prejudicial also with the environment: the war activities, the modern biotechnologies activities, the bioterrorism threats. The author ask himself if it could talk about the violence against the nature. He indicates that it is reasonable to talk about it from a position like the democratic ecology, but not from an ecofundamentalism posture.  Now, he emphasizes in how the legal system should guarantee the environment. He says that is necessary reinforce the legal and extra legal protection of values such as water, the biological diversity to their preservation and defense given the threat of their existence.  In this line, the socio environmental conflicts emerge as an events associate to the environmental concern derivate from a possible affectation of the nature. Those conflicts have as causes the fear of the contamination, the social problem, the fundamental rights violation, the state institutional weakness, among other things. In turn, they have clear consequences in the political, social and economic aspects. Later, the author tell us about the relationship between the disaster and the environment. For it, it is said that should be an integration of different approaches to achieve an accurate answer. Likewise, he says that a culture of prevention should constitutes in a state policy to avoid damage and affectations to society. In this way, the technology and the sustainable development could be a source for the prevention and reduction of risks and disasters. Over the same topic, he says that Law must have a framework of action before the disasters occurrence. Finally, the relationship between the Law and the violence requires a broad perspective, as well as having in mind the vision of the new paradigms. Within them, the environmental dimension is a main aspect that it should not neglected.

El autor señala que desde una perspectiva histórica hay una relación compleja entre el hombre y el ambiente. Es así que la concepción de la realidad influye en cómo el sistema jurídico regula aspectos relacionados al medio ambiente. A partir de una lectura dialéctica, se plantea el conflicto entre la actuación humana y la naturaleza. Se dice que la naturaleza reacciona debido a la afectación que sufre por parte del ser humano. Asimismo, no solo el cambio climático afecta al medio ambiente, sino una serie de actividades que también son perjudiciales con el ambiente: las actividades bélicas, las actividades biotecnológicas modernas y las amenazas del bioterrorismo. El autor se pregunta si se puede hablar de violencia contra la naturaleza. Señala que sí es razonable hablar de esto desde una posición como la de la ecología democrática, pero no desde una postura ecofundamentalista. Ahora, hace hincapié en cómo el sistema jurídico debería tutelar el medio ambiente. Dice que es necesario reforzar la tutela jurídica y extrajurídica de valores como el agua, la diversidad biológica para su preservación y defensa frente a la amenaza de su existencia. En esa línea, aparecen los conflictos socioambientales como eventos asociados a la preocupación ambiental derivada de una posible afectación de la naturaleza. Estos conflictos tienen como causas el temor de la contaminación, el problema social, la vulneración de derechos fundamentales, la debilidad institucional del Estado, entre otros. A su vez, tienen consecuencias claras en los aspectos económicos, sociales y políticos. Más adelante, el autor nos habla sobre la relación entre desastre y ambiente. Para ello, dice que debe haber una integración de distintos enfoques para lograr una respuesta adecuada. Asimismo, señala que una cultura de prevención debe constituirse en una política de Estado para evitar daños y afectaciones a la sociedad. De esa forma, la tecnología y el desarrollo sostenible podrían ser una fuente para la prevención y reducción de riesgos y desastres. Sobre lo mismo, señala que el Derecho debe tener un marco de actuación frente a la ocurrencia de los desastres. Finalmente, la relación entre el Derecho y la violencia requieren una mirada amplia, así como tener en cuenta la visión de los nuevos paradigmas.
