In this regard, the legal nature of “representation expenses” will also be analyzed in order to argue that they are in fact “travel expenses” who must be duly regularized.En el presente artículo, se analiza si la comisión del delito de peculado puede generar responsabilidad penal por el cobro y no devolución de “gastos de representación” realizados por los congresistas de la República del Perú cuando estos no realizan correctamente la labor de representación, puesto que este monto dinerario constituye un caudal de naturaleza pública que ha sido encomendado al funcionario público para su administración en razón de su cargo.
