This article carries out an analysis of the Peruvian regulations regarding one of the main protection measures, which is the legal obligation to request authorization from the Ministry of Culture to carry out works. After identifying the different legal categories of urban heritage, it will be shown that such categories determine a gradual and differentiated application of the required permits as well as of the authority with jurisdiction. Specifically, attention will be focused on the peculiarities of the gradual protection in a Monumental Zone, as well as for the protection of the surrounding area of a building designated as cultural heritage.El patrimonio histórico inmueble está conformado por los inmuebles de época posterior a la prehispánica que integran el patrimonio cultural de la Nación, sea en forma de barrios de una ciudad, como una Zona Monumental, o sea de forma individual como un Monumento, entre otras categorías. Este artículo realiza un análisis exegético de la normativa peruana respecto de una de las principales medidas de protección del patrimonio histórico inmueble, como es la obligación de solicitar al Ministerio de Cultura autorización previa para ejecutar obras. Luego de identificar las distintas categorías legales del patrimonio histórico inmueble, se evidenciará que las mismas determinan una aplicación gradual y diferenciada de los permisos requeridos, así como de la autoridad competente.
