In this context, this work aims to study and describe, in normative terms, the new legal regime that Law 31572 imposes on teleworking. The new Law refers to a special modality of provision of work, requiring a precise study centered on the impact of teleworking on essential elements such as the employment contract, its benefits, termination, among others. This means that Law 31572 regulates specific situations related to all teleworkers, regardless of the general labor legislation, namely Labor Productivity and Competitiveness Law. This study will address these specific rules.En septiembre de 2022, la Ley 31572 deroga la Ley 30036. Con ello, el régimen jurídico del teletrabajo en el Perú se modifica. En este contexto, el propósito del presente trabajo es estudiar y describir en clave normativa el nuevo régimen jurídico que impone la Ley 31572 al teletrabajo. Señala la nueva Ley que estamos frente a una modalidad especial de prestación de labores, lo cual nos obliga a estudiar con precisión el impacto que tiene el teletrabajo sobre los elementos esenciales del contrato de trabajo, sobre sus prestaciones, sobre la extinción, etc. Y es que, aunque la legislación laboral general, la Ley de Productividad y Competitividad Laboral, se aplique de forma automática a todos los teletrabajadores, la Ley 31572 impone reglas singulares para aquellos.
