Throughout the article, the doctrinal positions developed by various jurists with respect to the theory of law are appreciated: Von Savigny, Maine, Bohannan, Fuller, Hobbes, Bentham, Austin, Wendell, among others. And finally, the authors reflect on political theory and values in law with respect to the State.El presente trabajo aborda la concepción del derecho y las funciones que cumple en la sociedad. En ese orden de ideas, los autores inician analizando la concepción del derecho como “derecho de acción”, “set de procesos” y su función de ingeniería social. Por otro lado, los autores analizan el derecho, y sus valores, a partir del estudio de la doctrina del derecho natural, el positivismo y el realismo jurídico. A lo largo del artículo, se aprecian las posturas doctrinarias desarrolladas por diversos juristas respecto a la teoría del derecho: Von Savigny, Maine, Bohannan, Fuller, Hobbes, Bentham, Austin, Wendell, entre otros.
