The frame of reference that the author takes is the foundation of Habermas's discourse ethics. As an essay, the author starts from practical ethics and legal theory, presents the most important premises about what corporate social responsibility is from the interest group theory approach; with an emphasis on local communities; In addition, he tries to explain the reasons that justify why companies —especially extractive ones— have social responsibilities, exposing the most outstanding criticisms against the CSR approach and how such arguments suffer from drawbacks in their foundation. He proposes to understand CSR from the importance of dialogue understood from the theory of discursive ethics of Jürgen Habermas. Finally, it is about demonstrating how this habermasian approach of dialogue in CSR consolidates the proper exercise of rights.El objeto de este artículo es contribuir a esclarecer una discusión sobre el escenario de desarrollo de los stakeholders en el que se podría garantizar el diálogo entre las empresas y grupo locales. El marco de referencia que toma el autor es la fundamentación de la ética del discurso de Habermas. A  manera de  ensayo, el autor parte de la ética práctica y la teoría del Derecho, presenta las premisas más importantes acerca de lo que es la responsabilidad social empresarial a partir del enfoque de la teoría de los grupos de interés; con énfasis en las comunidades locales; además, trata de explicar  las razones que justifican por qué las empresas —en especial las extractivas— poseen responsabilidades sociales, exponiendo las críticas más resaltantes contra el enfoque de la RSE y cómo tales argumentaciones adolecen de inconvenientes en su fundamentación. Propone comprender la RSE a partir de la importancia del diálogo entendido desde la teoría de la ética discursiva de Jürgen Habermas. Finalmente, se trata de demostrar cómo este enfoque habermasiano de diálogo en la RSE consolida el debido ejercicio de los derechos.Pontificia Universidad Católica del Perú2010-06-15info:eu-repo/semantics/articleinfo:eu-repo/semantics/publishedVersionapplication/pdfhttp://revistas.pucp.edu.pe/index.php/derechopucp/article/view/2944Derecho PUCP; No. 64 (2010): Defense of University Autonomy.
