In this regard, the author addresses the practices employed in prison regimes for the treatment of prisoners and the transit of practices considered cruel and inhuman, involving physical punishment and/or isolation,  measures that consider the possible resocialization of the accused. Finally, the author closes the analysis by recognizing the importance of having new penological experiences that contemplate the readaptative treatment.El presente trabajo comienza mencionando que el estudio del derecho penitenciario es aún incipiente y desarrolla brevemente la historia de su formación y el establecimiento de prisiones en Norteamérica; así como su influencia en Europa y Latinoamérica. En ese sentido, el autor aborda las prácticas empleadas en los regímenes penitenciarios para el tratamiento a los reos y el tránsito de prácticas consideradas crueles e inhumanas, que implicaban castigo físico y/o aislamiento, hacia medidas que consideran la posible resocialización del reo.
