Originating in ancient Greek and Roman law, the protection of personal liberty was formalized with the Interdicto de Homine Libero Exhibendo. However this instrument had limited scope, it represented a starting point in creating tools for freedom protection. Based on this, the author explores the institution of habeas corpus in the history of England, the United States, France, Latin America and Peru. The article highlights the origin of habeas corpus in the Magna Carta of 1215 and its consolidation in the Bill of Rights of 1689 in England, and emphasizes its importance in protecting civil liberties and the limitation of state power. In this regard, the author notes that these English laws are the main precedent in the development of habeas corpus in Latin America. To conclude, he makes a brief review of habeas corpus in Peru, showing the challenges in its adoption until its constitutional consecration in 1920.El presente artículo aborda la evolución y la importancia del Habeas Corpus en la protección de los derechos individuales en diversos contextos políticos a lo largo de la historia, desde sus orígenes hasta su incorporación en el derecho peruano. Nacido en la Grecia antigua y el derecho romano, la tutela de la libertad personal se formalizó con el Interdicto de Homine Libero Exhibendo. Aunque este instrumento tenía un alcance limitado, representó un punto de inicio en la creación de instrumentos destinados a la protección de la libertad. Partiendo de ello, el autor explora la institución del habeas corpus en la historia de Inglaterra, Estados Unidos, Francia, América Latina y, finalmente, Perú. Destaca el origen del habeas corpus en la Carta Magna de 1215 y su consolidación en el Bill of Rights de 1689 en Inglaterra, para luego resaltar su importancia en la protección de las libertades civiles y la limitación del poder estatal. Al respecto, el autor señala que estas leyes inglesas constituyen el antecedente principal en el desarrollo del habeas corpus en América Latina.
