Finally, in order to illustrate the functioning of this institution, it presents a case decided by the Tribunal de Fiscalización Ambiental del Organismo de Evaluación y Fiscalización Ambiental, in which it declared null and void a decision of the investigating body ordering the extension of the limitation period without adequate justification.En el presente trabajo, el autor desarrolla algunos tópicos elementales sobre la caducidad administrativa del procedimiento sancionador, tales como la noción de potestad sancionatoria, su fundamento constitucional, y su finalidad y funcionalidad a partir de la regulación contenida en la Ley del Procedimiento Administrativo General. Finalmente, con el propósito de ilustrar la operatividad de esta institución, presenta un caso resuelto por el Tribunal de Fiscalización Ambiental del Organismo de Evaluación y Fiscalización Ambiental, en el que se declaró la nulidad de una resolución emitida por el órgano instructor mediante el cual se dispuso la ampliación del plazo de caducidad sin una justificación razonable.
