On the contrary, the rate of corruption in our country is on the increase, but the most scandalous thing is that these people, who are dedicated to diverting public goods or services, are free from the weight of justice, as they manage to flee the country until the criminal case against them expires and are exempt from any criminal sanction. In this line of thought, the study focuses on determining whether the imprescriptibility of criminal acts is an effective criminal policy to combat impunity in acts of corruption and, consequently, to reduce its criminal index to the extent that it is constituted as a means of general and special prevention, since it will be useless for them to try to flee from the Peruvian administration of justice, since the criminal action against them will not be subject to the statute of limitations. Los actos de corrupción que ocurren dentro de las instituciones estatales, ejecutados por un grupo minoritario de personas para obtener beneficios personales, son hechos intolerables, tanto social como jurídicamente, toda vez que se distorsionan los fines colectivos que persigue la Administración pública, llegando a afectar a la sociedad en general, ya que a causa de la corrupción no se concretarán actividades altruistas (hospitales, escuelas, puentes, carreteras) a favor de la ciudadanía. Sin embargo, hasta la fecha no existe política criminal alguna que combata de forma eficaz los actos de corrupción, sino todo lo contrario, el índice de corrupción en nuestro país es cada vez mayor; empero, lo más indignante es que estas personas que se dedican a desviar los bienes o servicios del Estado se libran del peso de la justicia, pues logran fugarse del país hasta que la acción penal en su contra prescriba, y se liberan de toda sanción penal. En esa línea de ideas, el estudio se centra en determinar si la imprescriptibilidad de la acción penal es una política criminal eficaz para combatir la impunidad en actos de corrupción y, consecuentemente, para reducir su índice delictivo en la medida que se constituya como un medio de prevención general y especial, ya que de nada servirá que traten de huir de la administración de justicia peruana porque la acción penal en su contra no prescribirá.
