However, this is often because the lawyer does not wish to become eventually involved in the facts under investigation or wishes to protect the investigated party who he sponsors – or sponsored – rather than for reasons directly related to professional secrecy or to the proper practice of the profession, hence our legal authorities and operators must pay close attention to prevent the poor use of the profession and of the right to professional secrecy. There are no neutral behaviors per se because anyone who can generically and abstractly be qualified as neutral, that is, criminally irrelevant and atypical, can acquire a criminal sense and therefore, be criminally relevant if certain conditions are met among which the incorporation of said conduct in a criminal context is essential.La práctica habitual forense en materia penal en nuestro medio normalmente se ampara en el ejercicio abusivo del derecho a ejercer la profesión de abogado y del derecho al secreto profesional, y cuya conducta criminal violatoria de la ley penal o transgresora del Código de Ética del Abogado se justifica con el argumento manido de la conducta neutral o socialmente adecuada. Pero esta responde muchas veces a motivos de no verse eventualmente involucrados en los hechos que se investigan o de querer proteger al investigado que patrocinan —o patrocinaron—, más que a razones que de modo directo tengan que ver con el secreto profesional o con el correcto ejercicio de la profesión, por lo que nuestras autoridades y operadores del derecho deben estar atentos para no permitir la mala utilización del ejercicio de la profesión y del derecho al secreto profesional.
