This assertion is not only notable for the news, but also for the criminal proceedings that are exposed in the judiciary, since this practice qualifies as a crime of sexual assault against minors, a subject that has been discussed arduously and recently in the Peruvian criminal jurisprudence. According to the above, if the aforementioned legal issue was discussed by experts in the last decade, how could the population be required to know about its prohibition and its criminal consequences? The greater number of persons prosecuted for sexual assault against minors alleges ignorance of its prohibition. However, this is an issue that, when brought to a criminal trial, requires a correct application of the criminal description, the parameters established by the Supreme Court of Justice, and qualified evidence in order not to generate impunity. In this line of ideas, it is necessary to try to understand if the factor of ignorance can be counteracted by the provision of a legal education containing basic information on criminal law and thus achieve mitigation in the incidence of the crime of sexual assault against minors.En pleno siglo XXI es inimaginable que los ciudadanos puedan vivir al margen de ley, y sobre todo de la ley penal; sin embargo, como paradigma tenemos que en ciertas ciudades del Perú es usual iniciar una convivencia y formar una familia con menores de edad de catorce años. Dicha aseveración no solo es notable por las noticias, sino además por los procesos penales que se ventilan en el Poder Judicial, pues dicha práctica califica como delito de violación sexual en menor de edad, tema que ha sido discutido ardua y recientemente en la jurisprudencia penal peruana. De acuerdo con lo señalado, si el precitado tema jurídico era discutido por expertos en este último decenio, ¿cómo podría exigirse a la población el conocimiento de su prohibición y sus consecuencias penales? La mayor cantidad de procesados por el delito de violación sexual en menor de edad alega desconocimiento respecto a su prohibición; no obstante, ello es un tema que llevado a un proceso penal exige una correcta aplicación: del tipo penal, de los parámetros establecidos por la Corte Suprema de Justicia y una probanza cualificada a fin de no generar impunidad.
