In this sense, when this judicial syllogism introduces a gender prejudice, it distorts the assessment of evidence, fails to identify the facts and distorts the correct application of legal norms. En este trabajo se analizará la problemática de fondo sobre el enjuiciamiento de género: la utilización nociva de estereotipos de género. Por su propia definición, enjuiciar supone valorar la prueba practicada en un juicio para identificar unos hechos a los cuales se les anuda una determinada consecuencia jurídica prevista en la ley. En tal sentido, cuando en ese silogismo judicial se introduce un prejuicio de género, se distorsiona la valoración de la prueba, se yerra en la identificación de los hechos y se tuerce la recta aplicación de las normas jurídicas.
