From there, we intend to discuss the application of the principle of procedural collaboration, as a mechanism before the application of the rules of distribution of the burden of proof, to seek a rationally justified and controllable judgment.El presente artículo tiene por objeto reflexionar sobre la aplicación de la carga de la prueba, prevista en el artículo 23 de la Nueva Ley Procesal del Trabajo, para los casos en los cuales la parte responsable de producir las pruebas las aporta, pero resultan insuficientes para la determinación de los hechos ocurridos que sustentan la pretensión.
